These Terms of Service ("Terms") govern your access to and use of the website kimtradesecret.com, our educational content, our email communications, and our free Telegram community (together, the "Service"), provided by KIM TradeSecret ("KIM TradeSecret", "we", "us", or "our").

KIM TradeSecret is a brand operated by a solo independent operator. Our identity is brand-only. You can reach us at support@kimtradesecret.com.

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Risk Disclaimer. If you do not agree, do not access or use the Service.

Educational Service Only

KIM TradeSecret provides trading education and a community focused on the gold (XAU/USD) market. Everything we offer is educational and general in nature. It is intended to help you learn about markets, concepts, and processes.

The Service is not, and must not be treated as, financial advice, investment advice, trading advice, or a recommendation to buy, sell, or hold any financial instrument. We do not provide personalised advice, we do not manage accounts or money, we do not place trades for you, and we do not act as a broker, dealer, financial adviser, or fiduciary.

Cost of the Service

The Service is currently provided free of charge. The education waitlist, the website content, and the Telegram community are all free to access. We do not take payment from you on this website.

If we introduce any paid offering in the future, it will be described separately and may be subject to additional terms. Any references in these Terms to amounts you have paid are included as standard wording and apply only if a paid offering ever exists.

The Education Waitlist and Communications

If you opt in to our education waitlist, you consent to receive educational content and notifications when new learning material is published. Participation is voluntary and opt-in. You may unsubscribe at any time using the link in our emails or by emailing support@kimtradesecret.com.

We may change, pause, or discontinue any communications, content, or community features at any time without liability to you.

Acceptable Use

You agree to use the Service lawfully and respectfully. When using the website, the email communications, or the Telegram community, you agree that you will not do any of the following.

• Use the Service for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms or applicable law.
• Present our content, or your own statements, as personalised financial advice, or solicit or provide regulated financial services through the community.
• Post or share spam, scams, get-rich-quick schemes, unsolicited promotions, or referral or affiliate links without our permission.
• Harass, abuse, threaten, defame, or impersonate any person, including us, other members, or third parties.
• Upload or distribute malware, attempt to gain unauthorised access to the Service, or interfere with its operation or security.
• Scrape, copy, resell, or redistribute our content or community discussions without our written permission.
• Share another person's private information, account credentials, or sensitive data.

Community Conduct

Our free Telegram community is provided for educational discussion. We may set additional community rules, and we may remove content or remove or restrict members who break these Terms or the community rules, at our discretion and without notice. Content posted by members reflects the views of those members, not KIM TradeSecret, and is general educational discussion only, not advice.

Intellectual Property

The Service and its content, including text, graphics, logos, the KIM TradeSecret name and brand, educational materials, and the arrangement of all of these, are owned by KIM TradeSecret or its licensors and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own personal, educational, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, sell, license, or create derivative works from our content without our prior written permission. Limitation of Liability

You acknowledge that all trading decisions are your own and that you trade at your own risk.

To the extent any liability cannot be excluded, our total aggregate liability to you for all claims relating to the Service will not exceed the greater of the amount you paid us, if any, in the twelve months before the event giving rise to the claim, or one hundred United States dollars (USD 100). Because the Service is currently free, the amount paid will typically be zero, and the USD 100 figure operates as a cap. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you, in which case our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless KIM TradeSecret and the operator behind it from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of any law, or your infringement of any third-party right.

Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Service, our users, or others. You may stop using the Service at any time, unsubscribe from emails, and leave the Telegram community. Sections of these Terms that by their nature should survive termination will continue to apply.

Governing Law and Disputes

These Terms and any dispute arising from them or the Service will be governed by the laws applicable to the operator's place of residence, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. The specific governing jurisdiction and venue will be confirmed by the operator and a qualified attorney before launch.

Material changes may be communicated through the site or by email where appropriate. Your continued use of the Service after an update means you accept the revised Terms. If you do not agree to the changes, you should stop using the Service.

Miscellaneous

These Terms, together with our Privacy Policy and Risk Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
